§1 GENERAL PROVISIONS

The following provisions constitute the privacy policy of INTERMET – KOTŁY GRZEWCZE, a limited liability limited joint-stock partnership with its registered office in Nowina (hereinafter referred to as the Privacy Policy). The Privacy Policy contains information regarding the collection and processing of data from users of the website operated at: (hereinafter referred to as the Website), including personal data.

The Website is operated by INTERMET-KOTŁY GRZEWCZE, a limited liability limited joint-stock partnership with its registered office in Nowina, address: Nowina 35, 82-300 Elbląg, registered by the District Court in Olsztyn, 8th Commercial Division of the National Court Register under KRS number: 0000438092, Tax ID (NIP): 5783111154, National Business Registry Number (REGON): 281447192, with a share capital of PLN 700,000.00 (hereinafter referred to as INTERMET – KOTŁY GRZEWCZE or the Administrator).

3. INTERMET – KOTŁY GRZEWCZE makes every effort to ensure that users of the Website can fully utilize its functionality. At the same time, INTERMET – KOTŁY GRZEWCZE ensures that the data provided by users of the Website, including their personal data, is secure and processed in accordance with applicable laws — including Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/4.

§2 INFORMATION ON THE PROCESSING OF PERSONAL DATA

  • when we need to pursue so-called legitimate interests, such as receiving and responding to your inquiry; resolving a dispute; maintaining business relationships; identifying representatives, contacts, or other employees or associates of our clients acting on behalf of those clients; preventing fraud and criminal activity, and protecting our IT systems; personalizing the online user experience and improving the performance, usability, and effectiveness of the Website, as well as the online presence of INTERMET – KOTŁY GRZEWCZE; conducting and analyzing our marketing activities, unless separate consent is required by law; fulfilling our corporate obligations and those arising from social responsibility; archiving correspondence for the purpose of demonstrating its history in the future; ensuring that the user can utilize the full functionality of the Website, including optimizing the use of the Website and adapting it to the user’s individual settings (preferences), as well as analyzing, verifying, and improving the operation, functionality, and performance of the Website and our marketing activities; creating and defining target audience lists for marketing purposes; analyzing and verifying users’ use of the Website, including so-called traffic analysis on the Website,

INTERMET – KOTŁY GRZEWCZE guarantees that personal data will be processed exclusively for specific, explicit, and lawful purposes. In each such case, we will provide you with all relevant information, including regarding that other purpose, prior to further processing.

7. We will process (including store) your personal data for as long as INTERMET – KOTŁY GRZEWCZE or its legal successor remains in business, unless otherwise specified in this Privacy Policy or in the terms of specific services or tools.

  • Google Analytics – to collect and analyze information related to the use of the Website (so-called on-site),
  • Facebook Pixel – to collect and analyze information about your use of our Website in order to create and serve you personalized ads on Facebook,
  • persons who, in the course of providing technical support services for the Website on our behalf, may potentially have access to your personal data,
  • subcontractors who may be involved in providing services to you, such as server maintenance and electronic communications.

In addition, your personal data may also be processed by authorities, government agencies, and other entities in cases where there is a legal obligation to disclose your personal data under applicable law (e.g., public administration bodies, organizational units, judicial and enforcement authorities, and healthcare providers). In each of these cases, we will strive to exercise the utmost care and protect your personal data.

12. Due to our use of Google Analytics, Facebook Pixel, and MailChimp, your data may be transferred to the United States of America (USA)

  • as it is stored on U.S. servers. The providers of the aforementioned services, tools,
  • and systems have joined the Privacy Shield program and thus guarantee the appropriate level of personal data protection required by European regulations.

13. In accordance with applicable law, you have the right to:

  • request access to your personal data,
  • request the correction of your personal data,
  • request the restriction of the processing of your personal data,
  • request the portability of your personal data,
  • to object to the processing of personal data,
  • to lodge a complaint with the supervisory authority (the President of the Personal Data Protection Office) regarding the processing of personal data,
  • to withdraw your consent to the processing of your personal data, if you have given such consent—you may withdraw your consent at any time, without affecting the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.

14. The rules governing the exercise of the rights listed above are set forth in detail in Articles 16–21 of the GDPR. At the same time, the rights listed above are not absolute and may not apply to all processing activities involving your personal data.

15. We do not base our decisions on automated decision-making, including profiling.

§3 DATA PROCESSING TOOLS

1. On the Website, we use tools and technologies that allow us to collect and process data regarding user visits (so-called automated processing of personal data). The data collected allows us to better understand and improve the operation, functionality, and performance of the Website, as well as to determine the effectiveness of our marketing activities, including through the analysis of demographic data.

2. Through the Website, we process the following data, including personal data:

  • information about the end device, browser, and operating system,
  • server date and time—i.e., the time at which the server collected data about the user relative to the server’s date.

  • analyzing, reviewing, and improving our activities, such as marketing initiatives; creating and defining target audience lists for marketing purposes;
  • analysis and verification of how users interact with the Website, including so-called website traffic analysis—both individual and aggregate-without identifying users personally.

  • Since Google LLC is headquartered in the United States and uses technical infrastructure located in the United States, it has joined the EU-U.S. Privacy Shield program to ensure the adequate level of personal data protection required by European regulations. Under the agreement between the United States and the European Commission, the latter has determined that Privacy Shield-certified companies provide an adequate level of data protection.
  • Google Analytics is used to automatically collect and analyze information related to the use of the Website (i.e., website traffic), including the number of visits, pages viewed, navigation between pages, time spent on the site, and other metrics. For this purpose, we use cookies from Google LLC related to the Google Analytics service. As part of Google Analytics, we also collect demographic data and data about interests.
  • We carry out these activities based on our legitimate interest (Article 6(1)(f) of the GDPR), for the purposes described in Section 5 (Cookies) – Item 8.
  • Because we have enabled IP anonymization, your IP address is truncated before being transmitted. Only in exceptional cases is the full IP address transmitted to a Google server in the United States and truncated there. The anonymized IP address transmitted by your browser as part of Google Analytics is generally not combined with other Google data.
